Terms of service

These terms govern use of the Pitch Perfect platform by clubs and their staff. By creating an account or using the service, a club agrees to these terms.

1. Definitions

  • Platform: the Pitch Perfect web application and related services.
  • Club: the football club or organisation that holds an account.
  • Staff: the club admins and coaches who use the platform on the club's behalf.
  • Guardian: a parent or guardian who receives reports.
  • We, us, our: Nation FC Ltd, trading as Pitch Perfect.

2. The service

Pitch Perfect helps clubs turn coaches' spoken or typed feedback into development reports for guardians. We provide the platform; the club is responsible for the people it invites, the data it enters, and the reports it approves and sends.

3. Accounts and security

Staff accounts are personal and must not be shared. The club is responsible for keeping sign-in details secure, for the actions taken under its accounts, and for removing access when a member of staff leaves.

4. Club responsibilities

As data controller, the club is responsible for having a lawful basis to process players' and guardians' data, for obtaining and recording any necessary parental consent, for the accuracy of the data it enters, and for managing which guardians may access which children.

The club must maintain appropriate safeguarding arrangements, including a Designated Safeguarding Officer, and follow its own and the relevant governing bodies' safeguarding procedures.

5. Acceptable use

Use of the platform must comply with our Acceptable Use Policy. We may suspend or restrict access where use breaches that policy or these terms, or where necessary to protect individuals or the service.

6. AI-generated content

Reports are drafted with the help of automated tools and are grounded in what the coach provides. They may nonetheless contain errors. Every report must be reviewed and approved by a coach before it is sent, and the club is responsible for what it chooses to send. We do not guarantee that drafts are free of mistakes.

7. Intellectual property

We retain all rights in the platform. The club retains rights in its own content and data. Clubs may use their own logos and branding within the platform and grant us a limited licence to display them for the purpose of providing the service.

8. Availability and warranties

We aim to keep the platform available and reliable but provide it on an as is and as available basis, without warranties beyond those that cannot be excluded by law. Some features depend on third-party providers and on a deployed public URL.

9. Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence. Subject to that, our liability is limited as set out in our commercial agreement with the club.

10. Suspension and termination

Either party may end the agreement as set out in our commercial terms. On termination we will, at the club's choice and within a reasonable period, return or delete the club's data, except where we are required to retain it.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
